1. Introduction and Acceptance

1.1 Agreement to Terms

Welcome to Focus Together ("App," "Service," "we," "us," or "our"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the operator of Focus Together, located in Baden-Württemberg, Germany.

By downloading, installing, accessing, or using Focus Together, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

1.2 Scope of Agreement

These Terms apply to:

• The Focus Together mobile application for iOS devices
• All features, services, and content provided through the App
• Any updates, upgrades, or new features added to the App

2. Definitions

For the purposes of these Terms:

• "Content" means any text, information, or other materials displayed through the App
• "Focus Session" means a timed period during which users engage in focused work using the Pomodoro technique or custom intervals
• "Local Storage" means data stored on your device that is not transmitted to any external servers
• "XP" (Experience Points) means the gamification currency earned through app usage
• "Streak" means consecutive days of meeting the daily focus goal
• "Advertisements" means promotional content displayed in the App through Google AdMob

3. Eligibility

3.1 Age Requirements

You must be at least 16 years of age to use Focus Together. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3.2 No Account Required

Focus Together does not require any account creation, registration, or sign-in. The app works completely offline, and all data is stored locally on your device.

4. Description of Services

4.1 Core Features

Focus Together provides the following services:

Timer Functionality

• Pomodoro timer with customizable work and break intervals
• Short breaks and long breaks with configurable durations
• Automatic break scheduling after configurable number of sessions
• Timer notifications and haptic feedback
• Ambient sounds for focus enhancement

Gamification System

• Experience Points (XP) earned through focus sessions
• Level progression based on accumulated XP
• Daily and weekly challenges with XP rewards
• Achievement badges for milestones
• Daily streak tracking

Statistics and Tracking

• Daily, weekly, and monthly focus time statistics
• Session history and completion tracking
• Goal tracking and progress visualization

Customization

• Multiple color themes
• Adjustable timer intervals
• Sound and notification preferences
• Daily goal settings

4.2 Offline Functionality

4.3 Data Storage

All app data is stored locally on your device using the browser's localStorage API. This means:

• Your data never leaves your device
• No cloud sync or backup is provided
• Uninstalling the app will delete all your data
• Data cannot be recovered if lost

5. Advertisements

5.1 Ad-Supported App

Focus Together is a free app supported by advertisements. By using the App, you agree to view advertisements displayed through Google AdMob.

5.2 Types of Advertisements

The App may display the following types of advertisements:

• Interstitial Ads: Full-screen advertisements displayed at natural transition points (e.g., when navigating to the Statistics screen)

5.3 Ad Frequency

To ensure a positive user experience, interstitial advertisements are limited to a maximum of one ad per 12 hours. This means you will see at most one interstitial ad every 12 hours while using the app.

5.4 App Tracking Transparency (iOS)

On iOS devices, the App will request your permission to track your activity for advertising purposes through Apple's App Tracking Transparency (ATT) framework. You can:

• Allow tracking: You may see more personalized advertisements
• Deny tracking: You will see general (non-personalized) advertisements

Your choice does not affect the frequency of advertisements or access to any app features.

5.5 Ad Personalization

Google AdMob may use device information and advertising identifiers to display personalized advertisements. You can manage your ad preferences through your device settings:

• iOS: Settings → Privacy & Security → Apple Advertising → Personalized Ads
• Google Ad Settings: adssettings.google.com

5.6 Third-Party Ad Content

We do not control the content of advertisements displayed by Google AdMob. The advertisements are provided by third parties and are subject to their own terms and policies. We are not responsible for:

• The content of any advertisements
• Any products or services advertised
• Any actions you take based on advertisements

6. User Conduct and Responsibilities

6.1 Acceptable Use

You agree to use Focus Together only for lawful purposes and in accordance with these Terms. You shall not:

• Violate any applicable local, state, national, or international law or regulation
• Interfere with or disrupt the App or any systems connected to the App
• Attempt to gain unauthorized access to any portion of the App
• Use any robot, spider, scraper, or other automated means to access the App
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
• Modify, adapt, or hack the App
• Remove any copyright, trademark, or other proprietary notices from the App

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Focus Together, its licensors, or other providers of such material and are protected by German, European Union, and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2 Trademarks

"Focus Together," the Focus Together logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Focus Together or its affiliates. You must not use such marks without prior written permission.

7.3 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install the App on your personal device
• Access and use the App for your personal, non-commercial use

7.4 Restrictions

You shall not:

• Copy, modify, or distribute the App or any portion thereof
• Sell, resell, rent, lease, or sublicense the App
• Create derivative works based on the App
• Use the App for any commercial purpose without authorization
• Remove any copyright, trademark, or other proprietary notices from the App

8. Privacy and Data Protection

8.1 Privacy Policy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, available at https://elibyt.github.io/privacypolicy-focus-together/. By using the Service, you consent to our data practices as outlined therein.

8.2 Local Data Storage

Focus Together stores all user data locally on your device. We do not collect, transmit, or store any of your personal focus data, statistics, or preferences on external servers.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 No Guarantee

We do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements
• Your productivity or focus will improve through use of the Service

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOCUS TOGETHER, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR:

• Any indirect, punitive, incidental, special, consequential, or exemplary damages
• Any loss of profit, revenue, data, use, goodwill, or other intangible losses
• Any damages resulting from loss of local data
• Any interruption or cessation of the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service

Our total liability shall not exceed €100.

10.6 Consumer Rights

If you are a consumer in the European Union, you may have statutory rights that cannot be waived. Nothing in these Terms shall affect such mandatory statutory rights.

11. Termination

11.1 Termination by You

You may terminate your agreement with us at any time by:

• Uninstalling the App from your device
• Deleting all app data through the App's settings

11.2 Effect of Termination

Upon termination (uninstalling the app):

• Your right to use the Service will immediately cease
• All locally stored data will be permanently deleted
• Provisions of these Terms which by their nature should survive termination shall survive

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

12.2 Jurisdiction

Subject to the dispute resolution provisions below, the courts of Baden-Württemberg, Germany, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

12.3 EU Consumer Dispute Resolution

If you are a consumer in the European Union, you may also make use of the European Commission's Online Dispute Resolution platform, available at: https://ec.europa.eu/consumers/odr

12.4 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact us at elibyteofficial@gmail.com to attempt to resolve the dispute informally.

12.5 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

13. Changes to Terms

13.1 Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date at the top of these Terms

13.2 Continued Use

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the new Terms, you must stop using the Service.
